Team: 6 paralegals and 1 lawyer. 92% of inheritance cases concern women.
Case 1 (Amina, 41): widow, unregistered customary marriage, 3 children. Her husband's family claims the house and the field according to custom. The traditional chief keeps a register of marriages; neighbours can testify. Amina is living with a cousin in Pemba.
Case 2 (Momade family): on returning to Mocímboa da Praia, the family finds its house occupied by a family displaced from another district (4 children), settled there in 2023 with a "declaration" from the neighbourhood secretary. The Momades have occupied the plot since 1998, without a written title; the neighbours and the neighbourhood chief confirm this.
Case 3 (collective): 140 households discover that part of their fields has been allocated to an agricultural investor. No record of community consultation has been found.
- Land belongs to the State. The land use and benefit right (DUAT) is acquired by administrative allocation, by occupation according to customary norms not contrary to the Constitution, or by good-faith occupation for at least 10 years. Testimonial evidence is admissible.
- The DUAT passes by inheritance without distinction of sex. The Constitution guarantees equality between women and men. Customary marriage is recognised if proven (customary register, witnesses).
- Any allocation of a DUAT to an investor requires prior consultation of local communities, with a signed record.
- Principles on Housing and Property Restitution for Refugees and Displaced Persons (Pinheiro Principles): right to restitution (principle 2); equality between men and women (principle 4); protection of secondary occupants (principle 17).

Common mistakes that cost marks

- Treating the neighbourhood secretary's "declaration" as a title.
- Ordering or supporting the eviction of the secondary occupant without a housing solution.
- Publicly exposing the leaders of a dispute against an investor.
- Measuring performance by the number of cases closed.
- Writing an advice note in legal jargon.
